Service Use Agreement

Welcome to Sudo E-commerce Co., Ltd. Please read this Agreement carefully before using or registering the Sudo Services because the contents contain important information about the Terms and Conditions related to your legal rights and remedies for you in the process of using the service.

Our Website and the Services on the website are built and owned by Sudo E-commerce Co., Ltd. Your use of the website and the services described on the website sudo.vn, meaning that you agree to the contents set forth in this Service Use Agreement.

Based on your business practice and legal regulations, we have the right to edit, update, add or remove part or all of the terms here without direct notification for you, but they will post publicly on our website.

In the case that one or more provisions of this Terms of Use conflict with the provisions of law and are declared by the Court to be invalid, such provisions shall not be effective and shall be amended to comply with the provisions of this Agreement. accordance with the provisions of this Agreement as required by applicable law. the remainder of the Terms of Use will remain in effect.

1. Limitations of Application

This regulation is applied to all issues related to the registration and use of the service: Domain, Hosting, Server, Content Management, SEO, between the service user and the service provider - Sudo.

2. Interpretation of words

In this regulation, the following words are construed with the meanings explained below:

"Service Users" are agencies, organizations and individuals that have accepted these provisions and registered to use the service in accordance with the procedures prescribed by Sudo.

"Services" mean all services provided by Sudo including: Domain Name Registration, Hosting, Server, and other related services.

3. Registration and use of the service

3.1 Domain Name Registration Service (Only for Vietnamese)

Domain Names chosen by organizations or individuals for registration must ensure that there are no phrases related to sovereignty, interests, national security, or violations of social ethics, resistance to customs and traditions of the nation, and it must show seriousness to avoid misunderstanding or misrepresentation due to polyphony and polysemy or when not using accents in Vietnamese - (point 2) according to Principle 6, Chapter II of Circular 24/2015/TT- BTTTT dated August 18, 2015 of the Ministry of Information and Communications regulating the management and use of Internet resources.

The domain name registrant must be fully responsible before the law for the purpose of use and the accuracy of the information provided, the subject must also ensure the registration and use of the domain name in accordance with regulations, not infringing upon the legitimate rights and interests of other organizations and individuals.

The registrants who register to use the domain name must not also be responsible for the management and maintenance of the domain use rights, and in any case of violation of the use of its domain name due to lax management. The registrants have to be responsible for managing and monitoring information on the operation status, validity period of the registered domain name (If you provide incorrect domain name registration information, you must be solely responsible and will not be refunded for the wrongly registered domain name). In all cases, domain names that do not continue to pay maintenance fees when due, will be automatically suspended and revoked according to regulations. For Vietnamese domain names (with the .VN extension) are revoked according to the provisions of Circular No. 24/2015/TT-BTTTT Regulations on management and use of Internet resources (after 35 days from the date the domain name expires).

When registering a domain name, organizations and individuals must provide full information about the domain name server to which it is pointed.

The owners must complete the domain name registration procedure according to the regulations of the domain name registrar.

According to the provisions of Circular No. 24/2015/TT-BTTTT on the management and use of Internet resources, the owners must provide issue registration declaration of Vietnamese domain name, or international domain name signed by the owners, and stamped (for organizations) on Sudo E-commerce Co., Ltd. with a certified copy of ID card of the owner or person representative (for the organization). After 07 days from the date of registration, the domain name will be suspended if there is a lack of documents as prescribed.

The owners must provide sufficient information and coordinate with Sudo and the competent state agencies to settle and handle the cases related to the domain name (if a dispute occurs).

When changing the name of the agency, organization or contact information such as: domain name manager, contact address, phone, fax, email box, identity card, Agencies, organizations and individuals must update Sudo for timely adjustment and update to ensure accurate information.

The owners are responsible for checking the information of domain name as soon as the domain name is successfully registered or maintained (refer to https://sudo.vn).

For the domain name Country ".vn": Ensure compliance with the regulations of Vietnam Internet Center on registration and use of domain names (details: Click here)

For international domain names, organizations and individuals lawfully operating in Vietnam, and using international domain names need to set up websites are responsible for notifying the use of domain names to the Ministry of Information and Communications at thongbaotenmien.vn. When there is a change in information, it must notify of such change according to Principle 23 of the Law on Information Technology dated March 20, 2009 stipulating the sanctioning of administrative violations in the management, provision and use of Internet services and electronic information on the Internet.

All problems related to “.vn” domain names, Sudo will solve according to regulations of Vietnam Internet Center (VNNIC). Refer to the agreement to use the .VN domain name here.

All disputes related to International domain names, Sudo will solve according to the regulations of the organization managing top-level domain names (ICANN). 

3.2 Web Hosting Service, Email, Virtual Server (Cloud VPS)

• We are not responsible for any legal or other liability for any information stored or accuracy of them on our server.
• We do not accept any liability or compensation for any loss or damage to the data stored on the server.
• The hosting packages at Sudo are designed to provide an environment for individuals, businesses, and organizations that need to operate small and medium sized websites. We do not limit bandwidth and capacity for the purpose of supporting customers to use the best service to avoid interruption when manipulating and operating the website. At Sudo, we prioritize the stability and safety of the service system. Therefore, when the monitoring system detects the misuse of bandwidth and capacity resources or signs of affecting the performance and stability of the system, we will notify and advise you to use another more appreciate service or limit resources and suspend this impactful service package.
• Service users must self-preserve all account information and customer data stored on our server.
• Do not arbitrarily transfer, give, donate, or resell the service without our approval.
• Do not store or transmit information and data with contents that distort, slander, defame, violate the law, go against the political line of Vietnam and other countries, or the contents related to pornography, debauchery, fraud that violate the Vietnamese national culture, customs, and traditions.
• Not store, transmit information, data directly or related to the content infringes patents, trademarks, trade secrets, copyrights, and other proprietary rights of any party.
• Do not use programs that are likely to clog or slow down the system, for example, using programs that take up system resources continuously, auto tools of any kind.
• Users are solely responsible for the contents of the emails sent and not used to send SPAM, ADVERTISING mails, BULK mails, MASS mails, BOMB mails or other programs, mail client source codes that affect the system, and IP reputation Sudo provides. Users must ensure that all sent emails are in accordance with Vietnamese culture and laws, especially the Law on Information Technology, and in safe forms.
• For Hosting and Email Services, data is backed up 1 copy per day and saved the last 3 copies. For the Server service with a maintenance package, Sudo will provide 2 additional backup copies (01 copy at the central server cluster, and 1 copy at another Datacenter). In case the customer liquidates the contract, the system would automatically delete the account and all related data within 15 days.

4. Payment

• Service users are responsible for paying in full and on time.
• Within 48 hours from the time-of-service registration, if payment is not made, all registration information to use the service will no longer be valid.
• Within the specified time to renew the service, if payment is not made, the service will be suspended and withdrawn according to regulations.
• For any loss or damage caused by late payment, Sudo are not bear any responsibility.
• Pending payment, if the domain name is registered to another individual or organization, Sudo are not bear any responsibility.

5. Information Security

• The service users are solely responsible for information security of the login name, password, preservation and changing of password, information and data related to the registered service and the accounts provided by Sudo.
• If there are Any loss or damage arising from the negligence of the service users to disclose information, Sudo are not bear any responsibility.

6. Termination or Cancellation of Service Provision

When we discover violations by any customer of the foregoing, we may unilaterally cancel the contract or immediately stop providing any related services to that customer without any notification. At the same time, we are not bear any responsibility and do not compensate for damages or refund fees.

7. Service Level Agreement (SLA)

We guarantee service uptime.

8. Refund Policy

We are committed to 100% refund when customers do not receive the service quality as expected (NOT applicable to domain name services).

9. Supplier Responsibilities

Sudo are not be liable and indemnify for any loss or damage incurred if the users fail to comply with the foregoing.
